General Purpose of our Terms of Service

Chalk Party exists to facilitate the most collaborative, open, and enjoyable drawing experience on Earth. This is a place for artists and casual doodlers to come together and create art that is fresh, fun, and belongs to everyone. To make this creative mashup as free and simple as possible, we use tools provided by Creative Commons to allow users to waive their rights to what they draw.

When you draw on Chalk Party, you dedicate your drawing as a free gift to the public domain, no strings attached!

This means that anyone can take all or part of something you drew, and remix it, replicate it, or otherwise do anything at all that they want with it.

We think that that's exciting for everyone.

There is an important place for artists to financially profit from their work, protect their creative property, and advance their careers through their efforts. This is not it. This is a party where everyone shares everything and draws just for the enjoyment of it.

While the user-generated content on Chalk Party is available for re-use under CC0, everything else on the site is governed by our Terms of Service.

Terms of Service

Chalk Party is operated by Chalk Party LLC. By accessing or using our web site at www.ChalkParty.com or using an app or mobile version of Chalk Party (together the "Site") you signify that you have read, understand, and agree to be bound by these Terms of Use ("Terms of Use" or "Agreement"), regardless of the means by which you (the "User") access, log-in, or use the Site. We reserve the right, at our sole discretion, to change these Terms of Use at any time without further notice. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) the Site.

Eligibility

Membership and/or use of Chalk Party is intended for users who are seventeen (17) years of age or older. Any registration by, use of or access to the site by anyone under age 17 is unauthorized and in violation of our Terms of Use. By using the Site, you represent and warrant that you are 17 or older and that you agree to abide by all of the terms and conditions in this Agreement.

User-generated and / or other content on the Site may be considered vulgar and / or offensive by Users regardless of their age. By using Chalk Party you assume the risk of being offended by User-generated and / or other content on the Site. Chalk Party is not responsible for offense and / or emotional trauma experienced by Users on the Site.

User-Generated Content Drawn on Site

All drawings made by Users on the Site ("User-Generated Content”) are available for reuse under CC0. (link) Users are responsible for the User-Generated Content they create. Chalk Party may, but is not obligated to, remove User-Generated Content at any time and for any or no reason.

Proprietary Rights in Site Content

All non-User-Generated Content content on the Site, including but not limited to, trademarks, trade dress, text, graphics, pictures, information, elements of the graphical user interface, software, files, names, characters, blog content, and their selection and arrangement (the "Site Content") are the proprietary property of Chalk Party with all rights reserved. No Site Content may be modified, copied, distributed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or part, without Chalk Party's prior written permission.

User Conduct

Chalk Party does not guarantee that it can or will monitor User-Generated Content. You represent, warrant, and agree by use of the Site that you will not infringe on these rules of User Conduct. Users may not, under any circumstances, do any of the following:

Chalk Party may, but is not obligated to, terminate the account of and / or ban from the Site any user, for any or no reason.

User Disputes

Any dispute that arises between you and other Users as the result of an interaction on Chalk Party is solely the responsibility of you and the other Users involved. Chalk Party may, but is not obligated to, monitor disputes between you and other Users.

Disclaimers

Chalk Party is not responsible or liable for the User-Generated Content drawn on the Site. While we do have rules for User conduct, we do not control and are not responsible for what Users draw or may access on Chalk Party. If you find that the content on Chalk Party is or may be objectionable to you, do not access or use the Site.

The Site may become unavailable for maintenance or other reasons. Chalk Party assumes no responsibility for lost or corrupted content as the result of Site maintenance, malfunction, or for any other reason. Chalk Party is not responsible for any technical malfunction in your hardware or software that results directly or indirectly, from your use of the Site. Chalk Party is not responsible for any loss or damage, personal injury, or death resulting from anyone's use of the Site, or the interactions of Users, whether online or offline.

Chalk Party may, but is not obligated to, store, transmit, replicate, and reproduce drawings created by Users.
